VENTURA COUNTY FAIR 2005 Exhibit and Concession POLICIES

The COMMERCIAL BUILDING closes nightly at 10:00 p.m., Friday and Saturday at 11:00 p.m. All outside exhibit space areas close at 11:00 p.m. daily. All outside Food Concessions close at 11:00 p.m. The Fair opens @ 11:00 a.m. daily except on Saturday and Sunday @ 10:00 a.m. due to the arrival of the Metrolink Trains and also 10:00 a.m. opening for Senior Day, Tuesday, August 9, 2005.

 

CONCESSION SPACE RENTAL POLICIES

The following policies shall apply to all Ventura County Fair concession space licensees:

It shall be the policy and practice of the Ventura County Fair to establish and revise from time to time, fees or rates to be charged to individuals or entities utilizing exhibit space during the annual Ventura County Fair.
Employees or officers of the 31st District Agricultural Association may not have a financial interest in any concession on the grounds of the 31st District Agricultural Association.

Fees or rates, as established for any particular area or facility pursuant to the criteria stated above, shall apply uniformly and without exception to any and all entities utilizing exhibit space within said area or facility.

The misrepresentation of concession ownership, operation or appearance on the application and photographs shall be grounds for immediate removal from the Ventura County Fair and the owner of such equipment waives all claims for damages against the 31st District Agricultural Association, its officers, agents and employees.

The Ventura County Fair Management reserves the final and absolute right to enforce policies, rules and regulations and to arbitrarily settle and determine all matters, questions or differences in regard thereto, or otherwise arising out of, connected with, or incident to the Ventura County Fair. It further reserves the right to determine unforeseen matters not covered by these rules, to amend or add to these rules as in its judgment it may determine necessary.

 

FEDERAL, STATE & COUNTY LAWS AND ORDINANCES
Board of Equalization, California State Sales Tax Permit: Concessionaires who will be selling or taking orders for merchandise must obtain a California State sales tax permit number. This number must be listed on the Concessionaires Rental Agreement. WORK PERMIT LAW
Licensees who employ youths under the age of 18 are required by law to see that such employee holds a valid work permit. They are further required to adhere strictly to all applicable Child Labor Laws.

 

CONCESSIONAIRE SPACE RESERVATION POLICY

A. It is understood and agreed that Concessionaires from previous fairs DO NOT automatically receive an invitation to return.

B. Each Concessionaires agreement is reviewed and acted upon in the best interest of the fair on an annual basis.

C. If invited to return, every effort will be made to allot the same space as in the prior year, but management has the right to move licensee to another location in the best interest of the fair at any time.

D. Returnees may request a different location. Every consideration will be given to such a request should space become available.

 

NEW APPLICATIONS

A. Anyone requesting information on obtaining space will be sent an application form. The application must be returned as soon as possible.

B. The application is not, in any way, a commitment by management or the applicant.

C. Consideration will be given to each applicant, and notification of acceptance or refusal will be made by the Concessions Office.

D. If no space is available, the applicant’s name will be placed on a waiting list.


SELECTION CRITERIA
Each application for space rental during the Fair shall be considered by management on the basis of:

a) Product balance on the Fair.
b) Uniqueness and appeal of product to fairgoers.
c) For returning applicants, a satisfactory history of cooperation with rules and regulations.
d) Ability to set up a professional, attractive display.
e) Application presentation.

PRODUCT SALES
The management may restrict duplication of brand names, trade name articles, products or services in any given area.


SUB-LEASING
Licensees are strictly prohibited from sub-leasing, assigning or apportioning the whole or any part of said rental space. Any licensee engaging in such actions is subject to having their contract canceled. All business transactions, regardless of their nature, must be done within the perimeter of the leased space. Conducting business outside of Concessionaire’s leased space will not be permitted by any personnel. Any concessions drawing a large crowd of people must insure that the crowd does not block aisles completely and prevent the normal flow of foot traffic.

CONCESSION LOCATION
Management shall assign concession space so as to provide fairgoers with a well balanced show which facilitates exposure to exhibits while allowing free flow of movement throughout the grounds.

EXHIBIT INSTALLATION AND CONSTRUCTION
All preparation for exhibits must be completed by l0:00 a.m. on opening day. Licensees will be responsible for the installation and disassembling of their own displays. No part of the display should interfere in any way with another exhibit.
